A Dutch court confirmed a 2021 consumer guard dog sentence that Apple has abused its dominant position by imposing staggered conditions on the suppliers of Apps of appointments within its App Store. According to reports, the District Court of Rotterdam served that the Dutch authority for consumers and markets (ACM) was justified in the imposition of an order with a sanction for non -compliance against the giant of technology. According to a Reuters news report report, the Court’s sentence supports the finding of ACM according to which the appointment app providers were forced to use the Apple payment system. These suppliers were also limited to referring to payment options outside the App Store and were required to pay a 30% commission (or 15% for smaller suppliers), observes the report.
Apple is planning to appeal to this sentence of the Dutch court
In a statement to Reuters, an Apple spokesman said: “This sentence undermines the technology and tools we have created for the benefit of the developers and protect user privacy and safety and we plan to appeal.”In 2021, the ACM imposed a fine of 50 million euros ($ 58 million) on Apple for not comparing the mandatory changes to its App Store, added the Reuters report. At that time, the regulator said that this fine was necessary to stop the practices that violated the antitrust laws of the European Union.
At the beginning of this month, the company presented a legal challenge against an order of the European Union (EU) who asked him to open his ecosystem strictly controlled to competitors such as Meta and Google.
The company has criticized the Digital Markets Act (DMA), defining it “deeply imperfect” and claiming that EU requests are “unreasonable” and could “hinder innovation”.As reported by Reuters, Apple said that EU requirements create “an unreasonable, expensive and innovation process”.
“These requirements will also deliver the companies hungry for data, which represent enormous risks for privacy and security for our EU users. These profoundly imperfect rules that are targeted only Apple – and no other company – will seriously limit our ability to provide innovative products and functionality to Europe, leading to a lower user experience for our European customers”. Apple said in a statement to Reuters.
