Aibe Exam: LLM passed a girl AIBE exam. When the matter reached the Gujarat High Court, a notice was sent to the BCI and sought a reply.

New Delhi (Aibe Exam)The Gujarat High Court has issued a notice to the Bar Council of India (BCI) on the petition of Urvi Acharya, an LLM degree holder who failed in AIBE. Urvi has accused of lack of transparency in AIBE. Urvi says that the Bar Council of India did not give any clear reason for its failure even after re -checking the copy. AIBE is a national level certification exam for law graduates.
Result made based on 92 questions out of 100
Urvi Acharya’s lawyer Prateek Jasani told the Gujarat High Court that 7 out of 100 multiple choice questions were withdrawn after the examination. After withdrawing 7 questions, the final result was released on the basis of 93 questions instead of 100. Accordingly, the passing marks should have been reduced from 45 to 42. The lawyer argued that the petitioner is a promising student and had passed the LLM degree in Criminal Law in the First Class. Urvi attacked all 100 questions. On withdrawing 7 questions, they should have got grace marks.
What is AIBE exam?
AIBE exam is given to practice after studying law. It gets a certificate by successful and only then the law graduates get permission to practice. Students of LLM Final Year can also take AIBE exam. AIBE is in Open Book format. It is designed to evaluate basic legal knowledge and assess the analytical capabilities of the candidates. Also, the minimum qualification benchmark for entry in the profession of law is also established.
What will happen after the High Court notice?
The Gujarat High Court has asked the BCI’s reason for the LLM degree holder failing. This will prove that the evaluation process was fair or there was any technical flaw in it. BCI will have to present facts and evidence in its favor. This will include the process of organizing and results of AIBE. If the court feels that there is a mistake in the evaluation, then the BCI may have to improve its process. This can not only give justice to this candidate, but other unsuccessful candidates can also get a chance to raise their complaints.
